Made
tawaaf al-wadaa' but unable to depart from Makkah straight
afterwards

Question: A man performed the Hajj
and made the tawaaf
al-wadaa' at night but was unable to leave Makkah
after the tawaaf
so remained in Makkah
until the morning. Then he travelled. What is the ruling (in
this situation)?
Response:
That which is legislated is that the tawaaf
al-wadaa' (for one having performed Hajj) should be just
before his departure from Makkah,
for that which is mentioned in the hadeeth of Ibn 'Abbaas
which is agreed upon (both by Imaam al-Bukhaaree and Imaam
Muslim): ((The people have been commanded that their last
act (before departure) should be (tawaaf)
around the House (Ka'bah)
except for the menstruating woman)). So, as long as he made
tawaaf
with the intention to depart at night and was unable to do
so until morning, then there is nothing upon him in (regard
to) that, inshaa.-Allaah.
And if he were to repeat the tawaaf
(al-wadaa') before (actually) departing, then this is better.
And
with Allaah lies all the success, and may Allaah send prayers
and salutations upon our Prophet Muhammad (sal-Allaahu
`alayhe wa sallam)
and his family and his companions.
